Hawaii Job Engine, LLC Terms of Use
 
The Terms and Conditions (referred to herein as “terms”) set forth below govern your access to and use of the Hawaii Job Engine (referred to herein as “the site”) website (located at www.Hawaii Job Engine) of Hawaii Job Engine, LLC (referred to herein as “HJE” and / or “we”) and are legally binding on you (referred to herein as “you” and / or “user”). If you do not agree with any of the terms do not access or otherwise use the site. Your access to and use of the site and / or its services shall be deemed your agreement to abide by all of the terms set forth below. HJE may at any time make changes to the terms, without notice, and it is your responsibility to review for updated terms from time to time, which will be posted on the site. Your continued use of the site and / or services shall constitute your consent to such updated / new terms.
Users who violate these terms may have their access and use of the site terminated, at HJE’s sole discretion. The terms are effective and binding as of January 20
th, 2012.
 
Attention: Employers may post jobs for hire for free to the site, with a maximum of 10 active job postings at any given time. Staffing Agencies may also post jobs for free to the site, with a maximum of 10 active job postings at any given time. Employers and Staffing Agencies who currently own, have an ownership stake in, or otherwise actively participate in the operation of job board(s) / job website(s), similar in concept to HJE, may not post jobs on the site. We monitor the site close and will take prompt action, should we suspect, or see any signs of, abuse of the site.
 
General  Use Rules
The site and the services are only intended for:
·         Employers seeking candidates for employment in the State of Hawaii
·         Individuals seeking employment in the State of Hawaii
·         Recruiters and / or Staffing Agencies searching for candidates on behalf of clients, which are clients seeking candidates for employment in the State of Hawaii
·         Third party vendors posting jobs on behalf of clients, which are clients seeking candidates for employment in the State of Hawaii

 
You must be of the age of 14 or older to use the site and the services. If you are under the age of 18, or the age of majority as defined in your jurisdiction, you may only use the site and the services under the supervision of a parent, legal guardian, or other responsible adult.
 
Use of Material
All information, documents, and services provided on the site, including trademarks, logos, graphics, images, videos, software, button icons, audio files and other material and or / content (collectively “Materials”) are presented to you by HJE. Except as expressly stated herein, you acknowledge you have no right, title or interest in or to the Materials on any legal basis. Parts of the materials are protected under copyright and trademark laws and all of the Materials are the property of HJE. Any unauthorized use of the Materials is strictly prohibited.
HJE authorizes you to download and print a single copy of the content available on the site solely for your personal and / or internal business purpose. You agree and acknowledge that you have no rights to alter, change, enhance, edit, or modify any of the Materials in any manner.
 
You agree that you are solely responsible for the content of any document you post on the site and the consequences arising from making such posting on the site. The use of the site is a privilege and HJE reserves the right, at its sole discretion, to terminate such privilege of use at any time for any reason.  If HJE decides to terminate your privilege of use, you must immediately destroy any printed or electronic Materials and cease to use the site and the services.
 
Use of Site
Users are prohibited from violating or attempting to violate the security of the site, including, without limitation to: 
·         Accessing date not intended for such user
·         Logging in to an account or server which the user is not authorized to access
·         Attempt to test vulnerability of the site’s security
·         Attempt to interfere with the usage of the site by any user or HJE, including, but not limited to submitting a virus, overloading, over-whelming, spamming, or crashing the site
·         Attempt to reverse engineer, disassemble, modify or otherwise attempt to discover the underlying computer code of the site
·         Sending unsolicited e-mail, including, but not limited to, promotions and / or advertisements or products and services
·         Attempt to use any device, software of other tool to interfere with the proper use of the site
·         Attempt to use any mechanism (including, but not limited to robots, browsers, spiders) to navigate or search the site
·         Impersonating any user of the site and / or the services
·         Take any action that imposes an unreasonable burden on the site
In addition to the foregoing you acknowledge and agree that HJE prohibits you from:
·         Provide any false or misleading information on the site about your identity, including but not limited to your name, contact details, employment history, education and / or skills
·         Post any false, inaccurate, or misleading information or any opinion or  notices
·         Post any submissions that are vulgar, discriminatory, hateful, obscene, sexually-oriented, threatening, harassing, abusive or otherwise objectionable
·         Post information to the site containing URL’s or links to promote your business, copyrighted material (unless you are the owner), trade secrets (unless you are the owner), material that infringes on the intellectual property rights of others or otherwise violates the privacy or publicity or others
·         Include any keywords which are unnecessary and / or irrelevant to the job opportunity being presented
·         Post any information relating to advertisements or solicitations of businesses, including but not limited to pyramid schemes, membership offers, multi-level marketing, referral marketing, distributorship
·         Post jobs which are unpaid (unless unpaid volunteer jobs if permitted by local, state, and federal laws) or only paid on a deferred basis
·         Post job opportunities to be based / located outside the State of Hawaii
·         Post job that are work from home (exceptions do apply: you may contact us and present your case why we should allow your work from home jobs to be posted. HJE will in our sole discretion decide whether to allow your work from home jobs to be posted. No work from home jobs must be posted prior to receiving an email from an HJE account confirming you may do so). 
·         Post the same job at the same location more than 1 time within a 30 day period
·         Have more than 1 of same, or highly similar (as determined in HJE's sole discretion), job posted at the same time for the same office location
·         Harass, stalk, and otherwise subject any user of the site to any inappropriate or unwanted contact
·         Post jobs which require payments from the applicant or requires any form of recruitment of other individuals
·         Post jobs for model, talent, entertainment, acting agencies
·         Post jobs including sexual services or seek employees for jobs of a sexual nature or jobs involving nudity
·         Post jobs requiring the use of human body parts including but not limited to reproductive services such as egg donations
·         Post jobs that does not comply with local, Hawaii State and Federal Law, including but not limited to laws regarding employment and labor, equal employment opportunity, and employment eligibility requirements
·         Post jobs, which requires applicant to provide information relating to his / her ethnic origin, political beliefs, physical and mental health, age, country of citizenship
·         Post jobs that does not represent bona fide employment
·         Post jobs that require citizenship of any particular country or lawful permanent residence of a particular country, unless required to comply with laws and regulations  
·         Use the site, services and / or materials for anything but to identify prospective candidates for user’s employment opportunities or user’s searching for candidates on behalf of clients seeking candidates for employment (in the case of recruiters) and finding employment opportunities for yourself
·         Collect information about any user for purposes other than that of the site and the services, as permitted herein
HJE reserves the right to remove any user and his / her information on the site, which does not comply with the above terms and / or is not in the best interest of HJE, as determined solely by HJE.
 
Additional for Employers, Staffing Agencies, 3rd Party Vendors (referred to herein as “Employers”)
Employers may, at any given time, while Employers have a job or multiple jobs posted on the site, edit or delete such job postings. Employers are allowed a maximum of 10 active job postings at any given time per company name. An Employer can anytime ad a new job posting, as long as Employer stays within the 10 active job posting limit, which may in some cases require Employer to delete a posting before adding a new posting (in case Employer had reached the 10 active job posting limit). Employers may not post jobs which the Employer may not be looking to hire for immediately. Employers may not post more than 1 of same or highly similar job across the same island at the same time (only 1 active job posting at any given time in such case). Employers who delete a job posting, may not repost the same and / or similar job before the date the originally posted job was due to expire (30 days counting from date of original posting) The Employer may repost the job after 30 days, should the Employer still have the same hiring need. Employer is required to delete any job posting, if the position has been filled. HJE’s team closely monitors all activities on the site and any sign of manipulation and / or abuse of the site, as determined in HJE’s sole discretion, may lead to HJE terminating your account.  
 
 
Registration and Password
In order to gain access to certain restricted parts of the site and the services HJE requires you to register on the site (“create an account”), which includes:
·         For Job Seekers, submitting a valid Email address and creating a password
·         For Employers, submitting a valid Email address, creating a password, Company Name, Business Address, Name of Contact, Contact Phone Number
·         For Recruiters, submitting a valid Email address, creating a password, Company Name, Business Address, Name of Contact, Contact Phone Number
 
After creating an account, the Email address and password you used to create the account are required to access certain restricted parts of the site and the services. Therefore, anyone with knowledge of both your Email address and password will be able to access your account. Accordingly, you must keep your password secret and confidential. You agree to assume sole responsibility for the security of your password, as well as any communication entered through the site, using your password. You also agree that you will make best efforts to present any third party from obtaining your password and accessing your account. If any third party should enter the site via your password, you agree to immediately notify HJE in writing.  
 
 
Links to Other Sites
The site contains links to other sites, which is meant as a convenience to you and is not, by any means, meant as an endorsement by HJE, of the content on such third party websites, and HJE does not make any representation regarding the content on such third party websites. If you decide to access such third party websites, you do so at your own risk.    
 
 
Intellectual Property 
All interest, right, and title to and in the site are the sole property of HJE. The site’s logo, other names and / or logos, slogans, design marks, are all the exclusive property of HJE. The design of the site, including but not limited to the button shapes, colors of the site, resume builder, graphic elements and layout are all the exclusive property of HJE. The content of the site is copyright @ Hawaii Job Engine, LLC, all rights reserved.
Except as otherwise stated herein - offering you a limited license as expressed in these terms - HJE does not grant you any rights.  HJE respects the intellectual property rights of others and we expect our users to do the same. HJE does not accept user submissions of copyrighted work, which constitute infringement of the copyrights of the owner.  HJE reserves the right to block and deny access to any user to the site and the services, should a user infringe on the copyright or other intellectual property rights of others.    
 
 
User Submissions
You acknowledge that you are responsible for the information and material you submit to the site and you will have full responsibility for the submission legality, accuracy, reliability, appropriateness, and copyright. You further acknowledge that you retain the ownership of any copyrights or other intellectual property you submit to the site. HJE does not represent or guarantee the truthfulness, reliability, or accuracy of any user content and neither does HJE endorse any opinion expressed by any user. Any reliance of content on the site will be at your own risk. 
Any information you submit to the site, in any form of media known, you grant HJE a worldwide, non-exclusive, royalty-free license to reproduce, link to, adapt, distribute, copy, use and derive work from the submission. You acknowledge and agree that any creative ideas, inventions, suggestions, materials, know-how or other content you sent to HJE, shall become the property of HJE.
If you post any content on the site, you also permit users to access, view, display, store and / or reproduce for personal use and / or internal business use. HJE may remove any content from the site, which, in HJE’s sole discretion, violates these terms, laws and / or regulations, is disruptive, abusive, illegal, inappropriate, harms and / or threatens users of the site and the services.
No information submitted shall be deemed confidential. However, HJE agrees to use your personal information in accordance with the HJE Privacy Policy.

  
Disclaimer of Warranty
The site is provided on as “as is” basis without warranty of any kind, express or implied, and may include errors, omissions and / or outdated information, which may affect the quality of the materials. HJE does not warrant that the site’s servers are free of computer viruses or other harmful mechanisms. If your use of the site results in the need to service or replace any equipment or data or other related costs, HJE will not be responsible for such costs.
HJE is not involved in any transaction between employers and candidates and HJE does not screen information posted on the site, including but not limited to job postings, resumes, cover letters, Emails, links included as part of job applicants. As a result, HJE is not responsible for user content, potential viruses or other harmful mechanisms included by users, the accuracy and / or trust of job postings, legality of job postings and / or resumes, ability of employers to offer employment to candidates and candidates’ ability to fill job openings.     
You assume the sole and full responsibility and risk of relying on the information, services, materials, products of the site, including but not limited to third party and / or HJE information, services, materials, or products. HJE makes no representation about the accuracy, quality, truthfulness, completeness of any information, services, materials or products or other forms of communications on the site, including but not limited to any third party content, information, services, materials and products linked to or accessed from the site. HJE provides the site and the services without any warranty of any kind.
HJE reserves the right in its sole discretion to remove user content from the site, but does not assume any obligation to so do, and will not be liable for failing to take such action.
Limitation of Liability
 
 
Limitation of Liability
HJE assumes no responsibility for the content posted by its users to the site, and HJE assumes no responsibility for the activities of its users. If HJE is notified by a user of another user content which does not conform with these terms, HJE may, at its sole discretion, decide to investigate and may also at its sole discretion determine whether to remove such content. However, neither HJE nor its employees, officers, directors, partners, affiliates, third party providers or content providers shall be liable to you or any third party for any types of damages, including but not limited to damages resulting from use of the site and / or the services, incidental and consequential damages, lost profits, lost data, lost employment opportunity, lost business opportunity and loss resulting from the use of external website linking to the site. However arising, whether in breach or tort, HJE shall not be liable to you for any form of damages.
 
HJE does not confirm that each user is who they claim to be. This means HJE does not verify Employers and Staffing Agencies are indeed real Employers and Staffing Agencies with an office and business operation in the State of Hawaii and HJE does not verify Job Seekers are indeed who they claim to be on their resume, cover letter etc. HJE is not engaged or involved in user-to-user dealings and therefore cannot control the behavior of its users and participants. In the event you have a dispute with another user or participant of the site, you release HJE from any potential damages, claims and / or demands of any kind of nature.   
 
 
Indemnification
You agree to defend, indemnify, and hold harmless HJE its employees, officers, directors, representatives, partners, affiliates, and agents from and against any and all liabilities, claims, costs, damages, including legal fees, alleging or resulting in connection with use of the site and / or the services, or breach of these terms.
 
 
General
HJE makes no claim that the site may be lawfully viewed and / or accessed out the United States. Access to the site may not be legal by certain persons or in certain countries. If you access the site outside the United States, you are solely responsible for compliance with applicable local laws. These terms will be governed by the laws of Hawaii, without regard to the choice of conflicts of law provisions of any jurisdiction. You shall bring any potential disputes, claims, or causes of actions related to these terms or in connection with the site to the courts located in Honolulu, Hawaii. 
If any provisions of these terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not impact and / or affect the validity of all other provisions of these terms, which shall remain in effect. The potential failure of HJE to enforce any right or provision of these terms shall not constitute a waiver of such right or provision, unless agreed to in writing by HJE.
No partnership, joint venture, agency relationship and / or employment relationship exist between you and HJE. These terms constitute the entire agreement between you and HJE.
 

Changes
HJE may at any time make changes to these terms of use, without notice, and it is your responsibility to review for updated terms of use from time to time, which will be posted on the site. Your continued use of the site and / or services shall constitute your consent to such updated / new terms.

Hawaii Job Engine, LLC (referred to herein as “HJE” and / or “we”) collects information about you (referred to herein as “you” and / or “user”), via its online website located at the URL www.Hawaii Job Engine (referred to herein as “the site”). HJE distributes such information about you to help you connect with employers. This Privacy Policy details HJE’s policies in regards to its handling of easily identifiable personal information submitted to the site.  As we update our service this policy may change / be adjusted, to please refer back to this site periodically.
 
Privacy
When you register with the site we will ask for your personal information. Personal information may include information about you and / or your company, including but not limited to email, password, full name, address, occupation, education, interests, phone number, company name, messages sent to other users, resume, cover letters, and any other information submitted to the site. HJE uses this information to process your request and to communicate with you about the status of your request. HJE also tracks certain information about how you use the site and we use this information for HJE’s own research.
While HJE will make every effort to keep your information confidential and secure, no data transmission over the internet can be guaranteed to be 100% safe and secure. HJE therefore cannot guarantee the security of any information and data you may sent to us – you share information and data on the site at your own risk. However, where users decide to share personal information such as their email address via the site, that information can be viewed and used by others and may result in unsolicited messages and contacts by third parties, which HJE is not responsible for.
 HJE may share your personal information with third parties, which are only third parties who help us in delivering the site’s products and / or services to you. Besides such third parties, HJE promises we will not sell, barter or otherwise share your personal information with any other third party. 

Social Media & Other Job Websites
HJE, its partners, employees, contractors and people otherwise associated with HJE may from time to time, at our sole discretion, take jobs posted on HJE and upload them to other job websites, affiliate marketing sites, and social media sites meant as a means to get additional exposure for the jobs posted.  
 
General
HJE may record your actions taken on the site, including but not limited to clicks, page views, IP address, and search queries. HJE may use your email address to send information, which includes but is not limited to Newsletters, which you may have elected to subscribe to during registration, account updates, special promotions, services that may be of interest to you, messages regarding your account.
HJE is completely secure and confidential. However, the site contains links to other sites and we are not responsible for the privacy policies and / or practices of websites to which you choose to link from the site. HJE cannot control the data use practice of users who may access your information on the site.
 
Children’s Privacy
The site and the services are not intended for, and may not be used by, children under the age of 14 years of age. HJE does not knowingly collect information about any children under the age of 14 years of age.
 
Retained Information
When you register on the site, HJE will ask you for personal information. HJE may collect and retain such personal information. However, you may decide to delete, review or edit personal information you submit to the site at any time. HJE will delete all your personal information, should you delete all such personal information. However we may keep logs, statistical and other demographic information about you. There may be instances where information you delete from the site will be temporarily cached and / or stored by other third party sites, which HJE does not have any control over and no responsibility for.

Hawaii Job Engine LLC Security

Hawaii Job Engine LLC (HJE) is dedicated to providing safest possible environment for all our users. We have dedicated a lot of resources to ensure we have solid security measures in place. Additionally, we monitor and track user activities on HawaiiJobEngine.com (HJE.com) in order to ensure a safe and secure environment online and also to instill confidence in HJE.

Work at Home job opportunities are NOT allowed to be posted on HJE.com, with rare exceptions as states in our terms of use. Work at Home job opportunities will often present an idealistic or unrealistic job opportunity, which may include a chance to earn big money with little work or limited skills required etc.  HJE strongly encourage Job Seekers NEVER to give out highly sensitive personal information during the initial application, which could be used to steal one’s identity. Highly sensitive information includes, but isn’t limited to Social Security Number, Driver’s License Number, Date of Birth. We recommend Job Seekers not to place this highly sensitive information on their resume.

Given our narrow geographical focus – exclusively focusing on jobs for the State of Hawaii – we are well-positioned to manage security issues. Regrettably, online companies are vulnerable to occasional scams and HJE does not expect to be completely immune.  However, HJE does not tolerate site abuse of any sort and our team will take all necessary actions to prevent abuse of the site and its services.
